أنشأ ميثاق منظمة الأمم المتحدة بصفته وثيقة دستورية قائمة على "مبدأ تقسيم السلطات"- وفق ما عبر عنه القاضي De Castro- ثلاث أجهزة هي الأهم في المنتظم الأممي وهي: مجلس الأمن، الجمعية العامة ومحكمة العدل الدولية، حيث حضي كلا منها بسلطات سيادية في مجال اختصاصها، وإذا كانت نصوص الميثاق قد كشفت عن وجود تعاون يجب أن يقوم بين الأجهزة الرئيسية للأمم المتحدة بالقدر الذي لا يخل بالإختصاصات الأصيلة لكلا منها، فإن الآليات القانونية التي وضعت من طرف الذين صاغوا الميثاق ذات يوم من عام 1945 للفصل بين هذه الإختصاصات، لم تكن حماسة وواضحة بالقدر المطلوب في الميثاق.
فإذا كانت العلاقة بين سلطات مجلس الأمن والجمعية العامة في ميدان حفظ السلم تحكمها آليات المادة 12 في عمومها، فإن العلاقة بين سلطات مجلس الأمن ومحكمة العدل الدولية ليس لها من آلية مماثلة عندما يباشر الجهازان وظائفهما في حل النزاعات الدولية، إلا بما جاء في نص المادة 36(3) مع ما يكتنفها من غموض في صياغتها ومن حيث تطبيقها، ناهيك عن الغياب الكلي لأية آلية تحكم العلاقة بين سلطات الجهازين، وهكذا إزداد هذا التساؤل إلحاحاً في الممارسة الدولية خاصة في بعض القضايا الدولية التي كانت محل نظر المجلس والمحكمة في آن واحد، وهو ما جعل اختياري يقع على موضوع الحدود الفاصلة بين مجلس الأمن ومحكمة العدل الدولية في مجال حل النزاعات الدولية، إحساساً مني بالأهمية البالغة التي شكلها الموضوع على صعيد الفقه والقضاء الدوليين، لذا فإن الموضوع سيتضمن فصلين، يحتوي كلا منهما على مبحثين ستكون الغاية منهما تغطية الجوانب الجوهرية للدراسة أو ما يفترض أنه يغطي هذه الجوانب، أما الفصلين فهما: (الفصل الأول: الحدود الفاصلة من حيث الإختصاص النوعي والتصدي للنزاع، الفصل الثاني: الحدود الفاصلة من حيث آليات التنفيذية والرقابة).
