التأمينات بمفهومها القانوني العام تعني الضمانات أو الوسائل التي يتقي بها الشخص خطراً معيناً، سواء أكانت التأمينات نتيجة سعي إرادي، كالتأمينات التي يتم التعاقد عليها مع شركات التأمين أو نتيجة تنظيم قانوني، كالتأمينات الإجتماعية التي تهدف إلى حماية الأفراد من الأخطار الإجتماعية التي تهدد آمنهم الإقتصادي كالمرض والشيخوخة والبطالة والعجز، إلخ.
أما التأمينات بمفهومها القانوني الخاص، فتعني ضمانات تنفيذ الإلتزام، أي الضمانات التي تؤمن الدائن من خطر عدم الوفاء بالدين وتتيح له إستيفاء حقه إذا حل أجله.
ومن جانب آخر، أحكام الإلتزام هي التأمينات القانونية التي تنظم إلتزام نشأ صحيح وتختص بتنفيذ الإلتزام وهناك كثير من الأحكام تتولى إنتقال الإلتزام ومسألة إنقضاؤه وهي تعني الإجراءات والضمانات التي يكفلها المشرع للدائن كي يحصل على حقه، ثم تأتي التأمينات الشخصية والعينية لتكون ضمن الإجراءات التي كفلها المشرع لحماية حق الدائن.
