الأخطار التى تهدد الشخص متنوعة وكثيرة، والتأمينات بمعناها الواسع يقصد بها كل وسيلة وتحمى الشخص من الخطر الذى يهدده. فنجد أن نظام التأمينات الاجتماعية يحمي الشخص من أخطار البطالة والمرض والشيخوخة.
على أن هناك نوعا من الخطر يهدد الدائن، وهو عدم تمكنه من الحصول على الحق الذى له قبل مدينه، إذا لم يف المدين بما عليه من دين اختيارا، وقد يكون التنفيذ الجبرى غير مفيد لعدم كفاية أموال المدين للوفاء بديونه، لذا فقد أوجز القانون نوعين من الوسائل لتأمين حق الدائن قبل مدينه.
النوع الأول: يسمى الضمان ، النوع الثانى: هو التأمين.
والتأمينات إما تأمينات شخصية، وصورتها المثلى هى الكفالة، وإما تأمينات عينية، وهى الرهن الرسمى وحق التخصيص، والرهن الحيازي وحقوق الامتياز، وسنتناول هذه التأمينات الشخصية والعينية بالدراسة، وسنقسم دراستنا إلى قسمين يتضمن القسم الأول التأمينات الشخصية( عقد الكفالة) أما القسم الثانى فنعرض فيه التأمينات العينية، الرهن بنوعيه وحق التخصيص وحقوق الامتياز.
