شكّلت حادثة التنصت على إتصالات الرئيسة البرازيلية السابقة ديلما روسيف والمستشارة الألمانية أنجيلا ميركل تجسيداً عملياً للإنتهاكات التي تمارسها الحكومات والشركات الخاصة على الحق في الخصوصية في العصر الذي بات فيه ممكناً الوصول إلى الكثير من حركة الإتصالات والبيانات الرقمية الأخرى.
الأمر الذي دفع الجمعية العامة للأمم المتحدة إلى إعتماد مشروع القرار رقم 68/ 167 بهدف حثّ جميع الدول والحكومات على مواءمة قوانينها الوطنية مع القانون الدولي لحقوق الإنسان، بما فيها التوصيات التي تضمنها القرار لجهة إنشاء آليات رقابية وطنية قادرة على حماية الحق في الخصوصية في العصر الرقمي وفق ما يتطلبه مبدأي القانونية وعدم التعسف.
في هذا السياق، جاءت هذه الدراسة لتسلط الضوء على خلفية القرار القانونية وأبرز ما تضمنه من إضافات وتوصيات يمكن ترجمتها عملياً على الصعيد الوطني اللبناني الذي إتُّخِذَ نموذجاً بحثياً لبيان مدى مواكبة نظامه القانوني للتطورات المستجدة في العصر الرقمي ومدى إنسجامه مع القانون الدولي لحقوق الإنسان ومضمون القرار رقم 68/ 167.
