يعد البيع، بلا جدال، أكثر العقود شيوعا وانتشارا فى حياتنا اليومية. وقد تضاعفت أهمية هذا الهقد فى الآونة الأخيرة، بعد التطور الهائل الذى حققه الانتاج الصناعى وتقدم أساليب توزيع المنتجات بصورة لم يسبق لها مثيل.
فلم يعد البيع يتم بأسلوب المساومة التقليدة التى تنتهى الى تحديد شروط البيع التى يتكون منها التراضى جوهر عقد البيع، كما تصور المشرع الفرنسىفى بداية القرن التاسع عش. بل أصبحت عمليات الانتاج والتوزيع بيد شركات ضخمة، تقوم بوفع شروط موحدة، تسمى بالرشوط العامة للبيع.
ولقد واكب هذا التطور فى أساليب الانتاج والتوزيع زيادة فى حجم المخاطر التى يتعرض لها المستهلكون فى تعاملهم مع هذه المنتجات الحديثة. فمن جهة ترتب على الانتاج الكبير ان ازداد احتمال أن تفلت بعض السلع مع رقابة المنتجين ومن جهة أخرى فقد ترتب على التطور سالف الاشارة فصل عملية الانتاج عن عملية التوزيع. وصارت هذه العملية الأخيرة بيد شركات كبيرة ينحصر دورها فى استخدام أساليب الدعاية المختلفة لاقناع المستهلك بأهمية السلعة وجدواها ونتيجة لهذين العاملين كان طبيعياً أن يتسع حجم الاضرار التى تسببها المنتجات الصناعية. وبرغم ادراك الجمهور لهذه المخاط، فان ذلك لم يقلل اقباله على المنتجات المصنعة، ومرد ذلك الى أمرين:
الأول يتمثل فى ازدياد أهمية هذه المنتجات وضرورتها.
والثانى: يتعلق بالدور الذى تلعبه وسائل الدعاية والاعلان
وقد اتجهت جهود القضاء، أولا، نحو تقرير حق المستهلك فى التعويض عن الاضرار التى تحدثها المنتجات بسبب ما فيها من عيوب.
