لما كان مطمع هذه الدراسة فى المقام الأول هو العمل على تقديم تحديد عام للأسس التى تقوم عليها ممارسة مهنة المحاماة فإنه فى تقديري إن البحث فيها لاتنحصر مباحثه فى ملاحقة نصوص تشريع المحاماة وإنما يجب أن يشمل كذلك علاقته بغيره من التشريعات الأخرى التى على اتصال نستمر به شأن قانون المرافعات المدنية والتجارية وقانون الإجراءات الجنائية.
وبأخذ ما تقدم فى الاعتبار يبقى أن نورد هنا كلمة توضيحية عن المنهج الذى نحبذه فى إجراء دراستنا للأحكام الخاصة بممارسة مهنة المحاماة. هذا المنهج يركز جل اهتمامه على معالجة هذه الأحكام فى إطار النظام القانونى المصرى السائد حاليا من خلال الاهتمام ببيان القواعد القانونية الوضعية الخاصة بممارسة مهنة المحاماة المقررة محل الدراسة بالارتباط مع الجوانب الفنية للمحاماة كما أنه يجنح إلى تبسيط هذه الدراسة إلى أقصى حد بالاقتصار على الخطوط العريضة لأحكام ممارسة مهنة المحاماة مكتفين فى هذا الشأن بالإشارة إلى ما كان منها مستمد من تشريع المحاماة والقوانين المتصلة به والآراء الفقهية واقضية المحاكم.
وعلى هدى الملاحظات المتقدمة عن المنهج المختار لدراسة ممارسة مهنة المحاماة فإننا نقدم على دراسة الموضوعات المتعلقة بإجلاء هذه الأحكام موزعة على خمس فصول متعاقبة على النحو التالى: الفصل الأول: فى مفهوم المحاماة, الفصل الثانى: فى اختيار المحامين وقيدهم فى جداول المحامين, الفصل الثالث: فى ضمانات المحامين, الفصل الرابع: فى حق الاستعانة بالمحامين, الفصل الخامس: فى مرافعة المحامى.
