تنص المادة 45 من قانون المرافعان على أن "يندب في مقر المحكمة الإبتدائية قاض من قضاتها ليحكم بصفة مؤقتة مع عدم المساس بالحق في المسائل المستعجلة التي يخشى عليها من فوات الوقت، أما في خارج دائرة المدينة التي بها مقر المحكمة الإبتدائية فيكون هذا الإختصاص لمحكمة المواد الجزئية، على أن هذا لا يمنع من اختصاص محكمة الموضوع أيضاً بهذه المسائل إذا رفعت لها تطريق التبعية، حول أحكام وآراء القضاء المستعجل يأتي هذا المجلد من إعداد المستشار "مصطفى مجدى هرجه"، وذلك وفقاً لأحدث الآراء الفقهية وأحكام النقض والصيغ القانونية، وقد قسمنا ذلك وفق خطة بحث تتكون من تسعة أبواب هي كالتالي: (الباب الأول: المسائل المستعجلة بنص القانون، الباب الثالث: دعاوى الحيازة، الباب الرابع: الحراسة القضائية، الباب الخامس: مسائل متنوعة، الباب السادس: الإختصاص المحلي، الباب السابع: الإختصاص الولائي للقضاء المستعجل، الباب الثامن: إجراءات التقاضي أمام القضاء المستعجل، الباب التاسع: الصيغ القانونية للدعاوى المستعجلة).
