Book Description
تقوم الدعوى الجزائية (الجنائية) على عدة مراحل, هى: الاتهام والتحقيق الابتدائى والمحاكمة, وتسبق هذه المراحل مرحلة تمهيدية هى مرحلة جمع الاستدلالات.
وأمام هذا التعدد نظمت القوانين المختلفة الأجهزة التى تباشر أصلا هذه المراحل وهى: الضبط القضائى الذى يباشر جمع الاستدلالات, والادعاء العام الذى يباشر الاتهام, وقضاء التحقيق الذى يباشر التحقيق الابتدائي, وقضاء الحكم الذى يباشر مرحلة المحاكمة.
وسوف تقتصر دراستنا هنا على مرحلة الاستدلالات ومرحلة التحقيق الابتدائى ومرحلة الإحالة دون الخوض فى التفاصيل التى تجرى فى التحقيقات التى تجريها المحكمة أثناء نظر الدعوى.
ويدل تاريخ قانون الإجراءات الجنائية (أصول المحاكمات الجزائية) على أن الدعوى الجنائية كانت ترفع إلى المحاكم الجنائية بواسطة المجنى عليه, ثم تطور, وأصبح من حق أى مواطن أن يحرك الدعوى الجنائية باسم المجتمع, وهذا ما عرف باسم (النظام الاتهامى).
ولقد تأثرت بعض الدول الخليجية بالنظام الاتهامى السابق والمميز لجميع الأنظمة الإجرائية الأنجلو سكسونية السائدة والولايات المتحدة الأمريكية. وعلى ذلك فالمشرعون فى بعض الدول الخليجية قد اختصوا جهاز الشرطة وأوكلوا إلى رجاله واسعه فى مجال الدعوى الجزائية حيث جعلوهم يهيمن على هذه الدعوى منذ لحظة علمهم بالجريمة وحتى الفصل فيها بالإضافة إلى صلاحياتهم فى إجراءات التحري, وجمع الأدلة.
وتتمثل أهمية موضوع هذه الدراسة فى إبراز تاريخ وتطور الادعاء العام فى الدول الخليجية, وكذلك فى المقارنة بين نظم دول الخليج ذاتها لتكون وسيلة من وسائل التقارب القانونى بين هذه الدول.
