يعالج العلاقة بين اختصاص المحكمة بنظر الموضوع وسلطاتها في إتخاذ تدابير تحفظية- الظروف التي تستوجب اتخاذ تدابير تحفظية.
بعد سلسلة من الخلافات التي نشبت بين تركيا واليونان حول حق كل منهما في استغلال الافريز القاري للجزر اليونانية الواقعة في بحرايجة، وإذ وصلت العلاقات فيما بين الدولتين إلى مرحلة من التوتر استدعت تعبئة القوات المسلحة لكل منهما خاصة بعد إرسال تركيا لبعض سفن الأبحاث التركية التي تحرسها البارجات الحربية لكي تقوم بدراسات علمية في المنطقة المتنازع عليها في بحرايجه، تقدمت اليونان بشكوى في العاشر من أغسطس سنة 1976 دعت فيها مجلس الأمن للانعقاد لبحث النزاع التركي اليوناني في هذا الشأن، وفي نفس اليوم تقدمت بعريضة أودعتها لدى قلم كتاب محكمة العدل الدولية ترفع بمقتضاها دعوى ضد تركيا.
وعلى الرغم من امتناع تركيا عن المثول أمام المحكمة، إلا أنه في السادس والعشرين من أغسطس سنة 1976 تلقي قلم كتاب محكمة العدل الدولية مذكرة من الحكومة التركية متضمنة "ملاحظات الحكومة التركية على عريضة اليونان باتخاذ تدابير تحفظية" قررت فيها أن محكمة العدل الدولية ليس لها ولاية نظر الدعوى، ومن ناحية أخرى فإن الحقوق التي تدعيها اليونان لا تقتضي على أية حال اتخاذ تدابير تحفظية، ومن ثم فقد طلبت الحكومة التركية في مذكرتها متن المحكمة ان تقضي برفض دعوى اليونان.
وفي الحادي عشر من سبتمبر سنة 1976 أصدرت محكمة العدل الدولية أمرًا قررت بموجبه رفض الطلب اليونان باتخاذ تدابير تحفظية، وقد تعرضت حيثيات هذا الأمر لمسألتين نعرض لهما بالتعليق في هذه الدراسة: أولًا: مدى ارتباط سلطة المحكمة باتخاذ تدابير تحفظيةبثبوت ولايتها بنظر موضوع الدعوى، ثانيًا: الظروف التي تستوجب اتخاذ تدابير تحفظية ومدى علاقة ذلك بالحق المراد حمايته، ونخصص لبحث كل مسألة من هاتين المسألتين فصلًا في هذا البحث.
