يعد الشيخ جمال الدين القاسمي الدمشقي، المولود بدمشق سنة 1866م والمتوفي سنة 1914م، من أهم الشخصيات العلمية التي نذرت نفسها لخدمة العلم الشريف بأسلوب قل نظيره بين العلماء، وتأتي اليوم رسالة المؤلف سامي بن الأزهر الغريضي عن الإمام الشيخ جمال الدين القاسمي واختياراته الفقهية، شديدة الأهمية تزيد التعريف بفقه الإمام ومنهجه الأخلاقي والعلمي، وآرائه الإجتهادية، إذ أن المؤلف بوقوفه على القضايا الفقهية التي طرقها القاسمي يعرض لنا "منهج القاسمي الفقهي ورأيه في الإجتهاد والإفتاء" كما يعرض لنا موقفه من "الإجتهاد والتقليد" ، وكيف كانت نظرته في "الإفتاء والقضاء".
وانطلاقاً من هذا الهم البحثي للمؤلف نجد أنه تناول ما يتعلق بنظرة القاسمي للخلاف الفقهي والدليل الشرعي، وكيف كان يرجح المسائل وبأي مقياس، كما تناول مدى مراعاة القاسمي لمقاصد الشريعة في فقه النوازل، وأبدى رأيه في مسألة التقليد وفي مقلدي زمانه، وتناول أيضاً الفتوى من حيث مستلزماتها وشروطها، متعرضاً لمسألة المذهبية في الإفتاء، وكانت له نظرة إصلاحية في ذلك. كذلك شملت اختياراته الفقهية المتنوعة الطهارة والصلاة والزكاة والصوم وفقه الأسرة والسياسة الشرعية من جواز قتل الجماعة المتماثلة بالواحد، ومعاملة أهل الذمة غير المحاربين، والردّ على شبهة سرقة أموال الدولة، والتعامل مع الوافدين إلى الدول الأجنبية فيما عُرف بمسألة "الكرنتينا" أي الوباء استناداً إلى قول رسول الله صلى الله عليه وسلم: "إذا سمعتم به بأرضٍ فلا تقدموا عليه وإن وقع بأرضٍ وأنتم فيها فلا تخرجوا فراراً منه" وكان للقاسمي رأي في هذا الأمر ...
