تحظى الأوراق التجارية بإهتمام واسع في عالم القانون، نظراً لأهميتها العلمية في ميدان النظرية والتطبيق، من جهة، ونظراً لأهميتها الإقتصادية في ميدان التجارة الداخلية والخارجية، من جهة أخرى.
فالأوراق التجارية تخضع لأحكام قانونية خاصة في غاية الدقة تتميز بتطبيق موحد تقريباً في معظم بلدان العالم نتيجة محاولات دولية عديدة تمخضت عن إتفاقية جنيف عام 1930 - 1931م التي تولت إيجاد قواعد موحدة للأوراق التجارية.
ولا بد من الإشارة إلى أن غالبية دول العالم قد اعتمدت قواعد إتفاقية جنيف في تشريعاتها الوطنية، كما فعلت غالبية الأقطار العربية ومنها سلطنة عمان، حيث استمد المشرع العماني معظم القواعد الخاصة بالأوراق التجارية من الإتفاقية المذكورة، فأفرد لها تنظيماً شاملاً ومفصلاً في الكتاب الرابع من القانون التجاري رقم 55 لسنة 1990 في المواد من 415 إلى 570.
وقد تم تقسيم هذا الكتاب إلى فصل تمهيدي وثلاثة فصول أخرى، جاءت كالآتي: الفصل الأول: "الكمبيالة"، الفصل الثاني: "السند الأمر"، الفصل الثالث: "الشيك"؛ ونظراً لقيام الباحثان بتدريس المادة في العديد من الجامعات العربية فقد اعتمدوا على المصادر المتوفرة في هذه البلدان، إضافة إلى مصادر أخرى مع الإشارة إلى بعض الإختلافات البسيطة بين قوانين التجارة في تلك البلدان.
