للزواج أهداف سامية جاءت بها الشريعة الإسلامية، فهو يهدف إلى إعفاف كل من الرجل والمرأة عن الوقوع في الحرام، وحفظ النوع الإنساني بالإنجاب، وبقاء نسل الزوجين واستمرار من يخلفهما، وبوجه عام شرع الزواج لإنشاء الأسرة التي يتكون منها المجتمع، بحيث يتعاون الزوجان في تحمل أعباء الحياة، وتحصل بينهما المودة والرابطة المقدسة التي سماها الله عز وجل "ميثقاً غليظاً".
ولتحقيق ما للزواج من أهداف كل بين شروطه (الكفاءة بين الزوجين) فإذا كان الزوج كفئاً للزوجة وقع الزواج لازماً غير قابل للفسخ إلا بسبب آخر، وشرط الكفاءة من شروط لزوم العقد، وشروط اللزوم تختلف عن شروط الصحة حيث إن الزواج بزوج غير كفء للزوجة يقع صحيحاً لكنه قابل للفسخ.
والكفاءة ليست حقاً للشرع، بل هي من حقوق العباد، فهي حق للمرأة، وهي كذلك حق لأوليائها كلهم القريب منهم والبعيد، فيصح التنازل عن هذا الحق كبقية الحقوق.
والأولياء إذا قاموا بتزويج المرأة من رجل غير كفء لها ولم ترض يحق لها طلب فسخ الزواج من القاضي، دفعاً لما يلحقها من الضرر المعنوي، وهو ضرر يؤدي لتعطيل أهم أهداف الزواج وهو المودة والألفة واستقرار وجود الأسرة.
وكذلك الحكم إذا قامت المرأة بتزويج نفسها من غير كفء فللأولياء طلب الفسخ، وهذا إذا لم يوجد ما يمنع الفسخ كما هو مبين في موطنه من كتب الفقه.
وقد أخذت قواني الأحوال الشخصية باعتبار الكفاءة وحق الفسخ.
هذا، وقد عني المؤلف في هذا الكتاب ببيان مفهوم الكفاءة وتمييزها عن العيوب الموجبة لفسخ النكاح، سواء ما يشترك فيه الرجال والنساء أو يختص به أحدهما، ثم شرح أهم عناصر الكفاءة، وهو النسب، والحرفة، مع تحقيق نفيس في أثر العرف على هذين العنصرين.
كما أنه اهتم كثيراً بدليل مشروعية الكفاءة من المنقول مع إيراده الأحاديث بأسانيدها وتخريجها وبيان درجتها، وكذلك تكلم عن حكمة مشروعية الكفاءة.
وقد عرض تلك البيانات في خمسة مواطن هي التي وردت عناوينها في المقدمة التي رواها المحقق "عبد الستار أبو غدة" نظراً لنقص صفحة من أول المخطوطة.
