إن موضوع الغنائم الحربية هو أحد أبواب الفقه المعروفة، وما تقرر بشأنها من وجوب قسمتها بين الغانمين -بعد تخميسها- هو الجادة التي لم يكن يعرف سواها قبل الاستنباط المنهجي والتحقيق العلمي الذي جاء به التاج ابن الفركاح الفزاري، حيث انتهى به اجتهاده إلى أن أمر الغنائم موكول إلى اختيار الأئمة (أولي الأمر) بحسب المصلحة, وقد استدل المؤلف على هذا الرأي الذي تميز به بأدلة كثيرة، وذكر الاعتراضات المحتمل إيرادها على رأيه وناقشها.
وقد أفصح عن رأيه هذا في مطلع الرسالة.. ثم انتهى في آخرها إلى أن الأصل قسمة الغنائم على الغانمين إلا إذا رأى الإمام أن المصلحة على خلاف ذلك، وهذا منه احترام لما ذهب إليه الفقهاء قاطبة.
والمؤلف من شيوخ ابن تيمية والنووي، كما أنه تلميذ العز بن عبد السلام.
وقد نواه ابن تيمية في إحدى رسائله برأي المؤلف وإن كان لم يأخذ به، وذلك في معرض إيجاد حل لموقف الناس من تداول تلك المغانم في الأسواق دون أن يسبقها التمليك للغانمين، كما أن ابن تيمية استنكر رأي النووي في التشدد في هذا، وطرح حلاً آخر.
