مفهوم الجريمة السياسية متغير دوما نسبي في جميع الحالات يتبدل بتبدل الآمكنة والازمنة وأصول الحكم والقواعد التى ترتكز عليها علاقات الدولة بالافراد وتبني عليها صلات الحاكم بالمحكوم فالجريمة السياسية تبعا لاختلاف النظم الايديولوجيات والافكار السياسية السائدة. ويرجع صعوبة تعريف الجريمة السياسية إلى الإلتزام بالتعريف القانوني (هو الفعل او الامتناع الذي يعاقب عليه القانون) او ( إعتبار كل فعل مخالف لقاعدة تجريمية بغض النظر عن موضوعه وغايته) لذلك كان من السهل ان نعرف الجريمة اطلاقا، لان مقياسها بسيط يتمثل في الخروج عن النص القانوني ولكن إذا تجاوزها هذا إلى التمييز بين الجرائم من حيث الموضوع نكون قد دخلنا ميدانا اجتماعيا وليس قانونيا بحتا، والميدان الاجتماعي ينظوي على عناصر معقدة ومتغيرة في الزمان والمكان.
