التنظيم القانوني للسلطة هو الحياة بالنسبة لجسد الدولة ووظيفة قوى الأمن الداخلي هي ذراع لهذا الجسد، لأنها هي المسؤولة عن حماية المواطنين وتأدية مصالحهم، وتحقيق الأمن والطمأنينة والإستقرار والتي هي غاية كل مجتمع، وفي سبيل تحقيق ذلك قد يقع رجل قوى الأمن الداخلي في مخالفة إنضباطية بقصد أو من دون قصد مما يستلزم معاقبته إنضباطياً.
فالنظام الإنضباطي يهدف إلى معرفة أوجه القصور التي أدت إلى وقوع المخالفة الإنضباطية من رجل قوى الأمن الداخلي.
فالحكمة من وضع نظام إنضباطي لقوى الأمن الداخلي تتمثل في محاولة إصلاح السلوك الإداري وتقويمه لدى رجل قوى الأمن الداخلي المخل بواجباته الوظيفية من خلال فرض العقوبات الإنضباطية على المخالف والمحافظة على كيان الوظيفة وحفظ هيبتها وضمان حسن سير المرافق العامة بإنتظام والمراد بث الطمأنينة لدى قوى الأمن الداخلي من خلال توفير أكبر قدر ممكن من الضمانات لهم إتجاه السلطات التي خولت صلاحية توقيع العقوبات الإنضباطية.
وتتجسد إشكالية الدراسة بالوقوف على الإطار القانوني للنظام الإنضباطي لقوى الأمن الداخلي، وإيجاد أسسه ومرتكزاته وضماناته القانونية ومدى كفاية تلك الضمانات.
وقد أثير كثير من التساؤلات على صعيد الفقه والقضاء ومنها مما هي الأسس القانونية للنظام الإنضباطي لقوى الأمن الداخلي في العراق والدول المقارنة؟ وما هي الفلسفة التي تقوم عليها هيئات قوى الأمن الداخلي مع مبدأ المشروعية؟...
إن نطاق الكتاب يدور حول الإطار القانوني للنظام الإنضباطي لقوى الأمن الداخلي محاولين وضع إطار عام للعقوبات الإنضباطية وضماناتها وعلى إجراءاتها لفرض العقاب في تشريعات قوى الأمن الداخلي في العراق ومصر والأردن.
