لما كان القانون المصري رقم 27 لسنة 1994 لم يكن بمنأى من التأثر بهذه التيارات التي اجتاحت التحكيم الدولي فإنه وإن كان قد تبنى بعضها على نحو صريح وواضح ولم يتبنى الآخر بشكل قاطع وصريح، فإن إظهار حدود هذا التأثر بهذه التيارات المعاصرة في إطار اتفاق التحكيم الدولي ونتائجه تبدو من الامور الجديرة بالدراسة، لما يترتب عليها من نتائج هامة على الصعيد النظري والعملي في آن واحد، هذا من ناحية، ومن ناحية أخرى فإن تيار التحرر من قيود القواعد الوطنية التي يحددها منهج تنازع القوانين وإحلال منهج القواعد المادية بدلاً منه ليحكم اتفاق التحكيم ذاته وأيضاً العديد من المسائل الأخرى المرتبطة بهذا الاتفاق، وهو تيار من صنع القضاء الفرنسي وخلقه، يتعين إظهار كيفية إعماله على اتفاق التحكيم لتبصره القضاء المصري بمزاياه وعيوبه والانتقادات الموجهة إليه.
ولما كانت أهم الاتجاهات المعاصرة بشأن اتفاق التحكيم تدور حول استقلالية اتفاق التحكيم والقانون الذي يحكمه، والآثار المرتبطة عليه فإننا نقسم هذه الدراسة إلى فصلين، نكرس كل فصل منها لبحث كل موضوع من الموضوعات المشار إليها.
