من أبرز ظواهر هذا القرن على الصعيد الجزائي، لجوء المجتمع الدولي، ممثلاً تارة بالأمم المتحدة، وطوراً بمجلس الأمن، إلى إنشاء المحاكم الجزائية الدولية الخاصة لمحاكمة كبار المسؤولين عن الجرائم الدولية الأكثر خطورة.
أثار هذا الميل إلى الإبتعاد أكثر فأكثر عن العدالة الوطنية لمصلحة القضاء الدولي تساؤلات كبرى حول ما تبقى من الدولة في ظل مصادرة صلاحيتها بمحاكمة من يرتكب الجرائم على أرضها، أي صلاحيتها الجزائية التي تمثل التعبير الأساسي عن سيادتها، كل ذلك بعد أن احتلت الدولة لفترة طويلة المركز الأساسي على الصعيد الدولي.
فإلى اي مدى يمكن لهذه الظاهرة أن تجسّد تغيّر مفاعيل القوى على الساحة الدولية، وميل الدفة لصالح المنظمات الدولية على حساب الدول وسيادتها في مجال المحاكمة وفرض العقاب عن الجرائم الدولية، وهل يمكن للمجتمع الدولي أن يؤدي بفعالية مهام الدولة الكلاسيكية بتحقيق العدالة؟
هذا ما حاول هذا الكتاب الإجابة عنه من خلال قسمين حيث تناول القسم الأول، طبيعة العلاقة بين المحاكم الجزائية الدولية الخاصة وسيادة الدول، ثم في القسم الثاني، النواقص التي تجعل من هذه المحاكم حلاً غير مثاليٍ.
ويجدر الإشارة، إن هذا المؤلف هو عبارة عن أطروحة دكتوراه نوقشت أمام لجنة من الدكاترة. وقد نالت المؤلفة تقدير جيد جداً مع تهاني اللجنة نتيجة هذه المناقشة.
