ما هو دور الشريعة في عالم اليوم؟ سؤال يلحّ على أذهان كثيرين، مسلمين وغير مسلمين، عوام وفقهاء، ساسة ومفكرين، وآخرين غيرهم. ربما يرى البعض أن الأمر واضح جليّ؛ فالشريعة هي الحكم وهي المهيمنة على أفعال البشر، وقد يعتقد آخرون أن أثر الدين في عالم اليوم أصبح هامشياً، وأن عالم ما بعد الحداثة وما بعد الدولة هو عالم بلا حدود، ولا يمكن لنظام واحد - دينياً كان أو غير ديني - أن يسيطر عليه أو أن يتحكم فيه.
ولكن طرح السؤال بهذه الطريقة ومحاولة الإجابة عنه بصورة مباشرة من دون تحليل تاريخي أو مفاهيمي يُعد أنموذجاً لحالة فكرية مشوبة بالتسطيح والتعميم من كل جانب. وهنا تأتي محاولة المؤلف في هذا الكتاب، لا للإجابة عن هذا السؤال ولكن لبيان الإطار العقدي والفكري والتاريخي والمعرفي لمسألة حيوية الشريعة وفتورها عبر التاريخ.
