تحليل القاعدة (الإجرائية) يكشف على الفور عن مضمونها، فهي قاعدة قانونية موضوعها تنظيم نشاط القضاء في كل ما يتعلق بنسبة الجريمة إلى مرتكبها والعقاب عليها.
أما هدف هذه القاعدة فهو اقتضاء حق الدولة في العقاب. وإذا أردنا أن نجمع هذا كله تحت لواء فكرة جامعة لقلنا إن مضمون القاعدة الإجرائية (الجنائية) هو في تنظيم نشاط السلطة القضائية في كل ما يتعلق "بالدعوى العمومية".
والقانون- في سبيل تحريك هذه الدعوى- يمد صاحب الحق بوسيلتين: دعوى عامة، الهدف منها اقتضاء حق العقاب عن الجريمة. ودعوى خاصة أو مدنية تابعة للدعوى الأولى، وهدفها اقتضاء حق التعويض عن الضرر المتولد عن الجريمة.
بهذا تنقسم الدراسة إلى جزئين: الأول: يتناول (الدعوى العامة) وما يتفرغ عنها من خصومات "الخصومة الجنائية والخصومة المدنية التابعة". والثاني: يتناول سير الدعوى العمومية حتى تشارف غايتها بصدور حكم بات، أو تنقضى بسبب آخر من أسباب الانقضاء.
