يُعد موضوع العلاقة بين القانون والأخلاق من الموضوعات الأكثر جاذبية لكثير من الكُتاب المتخصصين فى علم الاجتماع القانونى كما فى علم القانون وتاريخ وفلسفة القانون، ولا نغالى إذا قلنا أن التساؤل حول العلاقة بين نوعى القواعد التى تنظم السلوك: القاعدة القانونية والقاعدة الأخلاقية أصبح من أكثر الأسئلة المطروحة فى العصر الحديث سواء على القانونيين أو على الفلاسفة، إذ أرقت مشكلة العلاقة بين القانون والأخلاق أغلب الفلاسفة والمفكرين منذ مراحل مبكرة من تاريخ الإنسان على الأرض، والتى اعتبرت واحدة من أهم المحاور التى تتناولها فلسفة القانون، لدرجة أن البعض يطلق عليها "رأس القرن"، أى الصخرة التى تتكسر عندها الأفكار والنظريات فى بحر فلسفة القانون الهائج.
وبناء على ذلك فقد اخترنا أن نتناول موضوع العلاقة بين القانون والأخلاق فى الفكر القانونى الغربى الحديث بأعتبار أن هذا الفكر أصبح إماماً للفكر العالمى خلال الثلاثة قرون الأخيرة ، ومثالأً تحتذيه المدارس الفكرية الأخرى، فعلى سبيل المثال فإن الوضعية القانونية مثلاً هى نتاج للفكر الغربى غير أنها أضحت مدرسة قانونية سائدة فى المشرق والمغرب.
كلك فإن دراستنا لتلك العلاقة فى ذلك النطاق الفكرى والجغرافى المقصود منه إلقاء بعض الضوء على الأسباب التاريخية والفلسفية التى أدت لنوع من الخصام بين القانون والأخلاق فى القانون الغربى، بما لا يجب أن تتأثر به حضارات أخرى لم تواجه ذات الظروف والاعتبارات التاريخية والفلسفية.
وأخيراً فإن الأصوات التى خرجت حديثاً، خصوصاً بعد الحرب العالمية الثانية، وتعالت بعد سقوط المعسكر الشيوعى، لفرض قيم أخلاقية محددة باعتبار أنها قيم أخلاقية إنسانية وعامة ومطلقة، ومحاولة فرض تلك القيم على الثقافات الأخرى فى صياغات قانونية، مثل القانون الدولى الإنسانى وقانون حقوق الإنسان، وغير ذلك، ويجعل من الضرورى أن نعيد النظر والتدقيق فى تلك المقولات للتعرف على أصولها التاريخية والفلسفية واستنباط دوافعها السياسية والاقتصادية.
