الفقه الإسلامي غني بأصوله، كفيل عن طريق الإجتهاد أن يخضع كل جديد نافع لنظمه، ويطوعه لقواعده، وهذا الكتاب بيان عملي لكيفية مواجهة الإسلام لقضايا العصر، وتقديم الحلول الناجعة لها؛ إذ عالج موضوعاً مهمّاً، وهو شركة المساهمة في النظام والفقه الإسلامي؛ لأنها أهم الشركات؛ لإضطلاعها بالمشروعات الإقتصادية الكبرى، ولتضمنها أموراً كثيرة يحتاج الناس إلى بيان أحكامها، مثل الشخصية المعنوية، والذمة في الفقه والقانون، وقصر مسؤولية الشركاء عن ديون الشركة على رأس مالها، وقد بيَّن البحث حكم شركة المساهمة، وتكييفها، والأسهم، وخصائصها، والحقوق التي تمنحها لأصحابها، وحكم تداولها، وأن جواز ذلك مقيد بالنظر إلى نوع رأس مالها ونشاطها، وبيّن انواع الأسهم، وحكم كل نوع منها، كالأسهم العادية، والأسهم الممتازة، وأسهم رأس المال وأسهم التمتع، وأسهم الإستهلاك، وكذا أدوات الدين، والصكوك التمويلية، وحكمها شرعاً، ومزاياها، وأقسامها، وخصائصها، وتداولها، وتحويلها إلى أسهم، وتصكيك الديون، إلى غير ذلك من الأمور.
واشتمل على من يحق له رفع الدعوى، وتعلق الضمان بالشركاء في الفقه والقانون، وبيَّن البحث حكم إخراج زكاة الشركات التجارية والصناعية والزراعية والعقارية والمواشي، وزكاة المستغلات، والجهات التي تعفى من الزكاة.
وأوضح الكتاب أرباح الشركات وخسائرها، ومراقب الحسابات، وتعرّض لمجلس الإدارة، وحدود صلاحياته، وجمعيات الشركة في الفقه والنظام، وأسباب إنقضاء الشركة نظاماً وفقهاً، وغير ذلك.
