إن لدراسة القضاء الإداري أهمية نظرية وأخرى عملية، أما أهميتها من الجانب النظري فتظهر في غرضين أساسيين أحدهما يهدف إلى حماية حقوق الأفراد وحرياتهم وأما الثاني فيبدو في تقويم الإدارة وإجبارهم على إحترام مبدأ الشرعية والخضوع لسلطانه.
ويتحقق هذان الغرضان عن طريق رقابة القضاء لتصرفات الإدارة للتأكد من مدى مطابقتها أو عدم مطابقتها للقوانين واللوائح مع ما يرتبه ذلك من إلغاء كل تصرف للإدارة أو التعويض عنه متى كان منطوياً على مخالفة لمبدأ الشرعية.
أما الجانب العملي من هذه الدراسة فيعني أنه كلما اتسع نشاط الجهاز الحكومي في بلد معين واتجه النظام الإداري فيها صوب التقدم كلما تعددت التشريعات وتنوعت بقصد تنظيم الأوجه المختلفة لهذا النشاط وإدارته.
وإن القضاء الإداري ليس مجرد قضاء تطبيقي كالقضاء العادي بل هو في الأغلب قضاء إنشائي يبتدع الحلول المناسبة للروابط القانونية التي تنشأ بين الإدارة في تسييرها للمرافق العامة وبين الأفراد وهي روابط تختلف بطبيعتها عن روابط القانون الخاص.
ولذلك يقتضي من القائمين على القضاء الإداري مجهوداً شاقاً مضنياً في البحث والتمحيص والتأصيل ونظراً ثاقباً بصيراً بإحتياجات المرافق العامة للمواءمة بين حسن سيرها وبين المصالح الفردية الخاصة.
