أردت من وراء هذا البحث إظهار حقوق المؤلفين وإلتزاماتهم إزاء الناشرين من الناحية الشرعية والقانونية حتى يكون الجميع على دراية بما له وما عليه، وبالتالي يتحقق العلم الكافي بالحكم الشرعي والنص القانوني قبل توقيع العقوبة المقررة، وقد أوليت اهتمامي من الناحية القانونية بقانون حماية الملكية الفكرية الجديد رقم 82 لسنة 2002 م باعتباره أحدث قوانين حماية الملكية الفكرية مع الإستئناس بقوانين حماية الملكية الفكرية السابقة عليه، وكذا بعض القوانين الأجنبية في مقدمتها القانون الفرنسي إذا دعت الحاجة إلى ذلك متقدماً ذلك كله بيان أحكام الشريعة الإسلامية الغراء حتى تتم الفائدة ويكتمل النفع وقد حرصت أن يكون عرضي للأحكام وافياً بالغرض المقصود معتمداً في ذلك على الأسانيد الشرعية الصحيحة وحسن العرض ووضوح العبارة.
