بقيت الشهادة أحد أهم أدلة الإثبات في المسائل الجنائية وأكثرها تداولاً في القضاء الوطني، إلا ان أهميتها في الإثبات في القضاء الجنائي الدولي قد تميزت عن ماهي عليه في القضاء الوطني، كونها مرت بمرحلتين:
الأولى: في ظل المحاكمات الجنائية الدولية السابقة المتمثلة بمحكمتي نورمبرج وطوكيو، لم يكن للشهادة الجنائية دور يستحق الإشارة، وكان التعامل بالشهادة في محاكماتهما شكلياً، فالدور الأبرز حظيت به الأدلة المادية في محاكمة مجرمي الحرب الألمان واليابانيين.
الثانية: تمثل هذه المرحلة القضاء الجنائي في ظل محكمتي ICTY و ICTR والتي اعتمدت الشهادة بشكل رئيس في الإثبات الجنائي في محاكماتها، تساندها أدلة الإثبات الجنائي الأخرى، والسبب يعود إلى كونهما شكلتا بعد أن حصلت الإنتهاكات الخطيرة للقانون الدولي الإنساني في إقليمي يوغسلافيا السابقة ورواندا، فقد سعى مرتكبوها إلى إتلاف وإخفاء الأدلة المادية التي تثبت تورطهم بإرتكابها مستفيدين من علاقاتهم بالسلطات الحكومية الرسمية، فضلاً عن تأثير الظروف الجوية في المساهمة في إضمحلال ما تبقي من هذه الأدلة، ولم يبقى إلا ما اختزنته ذاكرة الناجين من ضحايا هذه الجرائم، الذين يعدون الشهود الرئيسين في كشف ملابسات هذه الوقائع الإجرامية.
لذلك حرصت محكمتي ICTY و ICTR على إبتكار أساليب تشجع الشهود والضحايا للإدلاء بشهاداتهم أمامها، فضلاً عن إقرارهما للعديد من الإجراءات التي تجيز القبول بالشهادة الخطية بقسم، والإدلاء بالشهادة عبر وسائل التقنية الإلكترونية عن بُعد، وإعتبارها أدلة إثبات معتبرة، ومنح الشهود الحماية الكافية لضمان أدائهم الشهادة من دون تردد أو خوف في إطار تعاون بناء مع الدول المعنية والمنظمات الإنسانية الأخرى.
وأن المحكمة الجنائية الدولية الدائمة ICC قد سارت على نهج محكمتي ICTY و ICTR وطورته بما يخدم العدالة الجنائية الدولية المتوازنة التي راعت فيها ضمان أداء الشهادة وعدم المساس في حقوق المتهم، مستفيدة بشكل كبير من تجارب المحاكمات التي سبقتها.
