تعد المصلحة عامة قوام الدعوى وركنها الأول الأساسي لرفعها لضمان جديتها، سوا في مجال الثضاء العادي أو في مجال القضاء الإداري، حيث يشترط عامة في رافع الدعوى أن يكون له منفعة يمكن تحقيقها في حالة تحقيق طلباته، واذا لم يكن له مثل المنفعة فلا تقبل دعواة.
وسوف نقسم دراستنا لموضوع شرط المصلحة كأحد شروط دعوى الالغاء في فرنسا ومصر والسعودية الى فصول ثلاثة نقدم لهم بفصل تمهيدي، نتناول في الفصل الأول دراسة استخدام القصاء الاداري الفرنسي فقط -دون القضاءين المصري والسعودي- شرط المصلحة كوسيلة للحد من رقابته لأعمال الادارة في النصف الثاني من القرن التاسع عشر، وذلك من خلال ربطة المصلحة بالحق، ثم تراجعه عن هذا الربط ثم توسيعه لشرط المصلحة بالنسبة لطعون الأفراد وتقييده بالنسبة لطعون الجماعات المهنية المختلفة.
أما الفصل الثاني، فسنتناول فيه دراسة الشروط الأساسية التي يجب توافرها في المصلحة لرفع دعوى الالغاء في فرنسا ومصر والسعودية. أما الفصل الثالث فسنخصصه لدراسة أنواع المصالح في دعوى الالغاء.
