أن قيام السلطة والنظام في المجتمع ليس هو الهدف المرجو في حد ذاته والذي تسعى وراءه الجماعة لتحقيقه وإنما هي تسعى لتجعل السلطة وسيلة لتحقيق النظام، وبحيث يصبح النظام وسيلة لتحقيق سعادتها وتحقيق أمنها واستقرارها، لذلك فإن السلطة حين تقوم بممارسة أعمالها عليها أن تجسد فكر المجتمع ومعتقده وهدفه في المستقبل وتهبط به من عالم التصورات إلى عالم الواقع في شكل قواعد وسلوك معلومة رسمياً للناس وتحميها كل أنواع الجزاءات المناسبة كلما حاول بعضهم الخروج عليها أو الزيغ من أحكامها، كما أن عليها أن تظل عينها شاخصة وفاحصة لكل جديد مستحدث له أثره أو تأثيره العاكس على حياة الناس وتلبي المستجد النافع الذي فيه الصالح العام المشترك وتنأى عن الضار الذي لا يحمل نفعاً ولا صالحاً، ويترتب على ذلك أن السلطة الصالحة مضاف إليها قانون عادل وصالح يحقق المعادلة اللازمة لوجوب طاعتها واحترامها بل ونصرتها والدفاع عنها، إلا أن المجتمع قد يبتلى بحكم حاكم جائر يبسط طغيانه وينشر بغيه وعدوانه، ومن ثم وجبت معارضته ومواجهته ومقاومته، لأنه خرج عن إطار مهمته ونطاق عمله وخرج عن حدود الوكالة أو الإنابة أو الإجارة، وظلم شعباً إإتمنه وولاه زمام أمره، وعن شرعية مقاومة الحاكم الجائز أفاض الفكر السياسي الوضعي والإسلامي على السواء ما بين مؤيد ومعارض.
ولأن لكل مجتمع عقيدته وفكره وقيمه التي ترسم له إطار حركته وتحدد له معالم أهدافه - لهذا آثرت أن يتناول بحثي عن (شرعية السلطة والنظام في حكم الإسلام) المجتمعات الوضعية وفق ما تقوم به نظم الحكم كدراسة مقارنة وذلك لبيان ذاتية وتفرد النظام الإسلامي واستقلاليته عن غيره من نظم الحكم الوضعية ويتضمن الكتاب الأبواب التالية: الباب الأول: شرعية السلطة وسند طاعتها، والباب الثاني: أطر ممارسة عمل السلطة وأدوات الممارسة، والباب الثالث: السلطة الجائزة وحق الشعب في الدفاع الشرعي العام.
