لقد سبقنى في بحث موضوع شروط عدم المنافسة اساتذة افاضل ومع ذلك فقد اخترته موضوعا لبحثي لاعتبارات عدة.
فمن ناحية أولى استجدت في الموضوع تطورات قانونية كثيرة سواء في عالم الفقه أو عالم القضاء.
ومن ناحية ثانية فان اهمية عدم المنافسة تتجدد باستمرار مع تجدد التطورات الواقعية في نطاق علاقات العمل وما يرتبط بها من مفاهيم حديثة، وحيث تحاول هذه الافكار والمفاهيم ان تحقق هدفا مثالثا هو التوفيق بين مقتضيات الحماية المرجوة للعمال وتوفير حماية كافية لمصلحة المشروعات الصناعية والتجارية.
واخيرا فإن احد قطاعات مشكلة عدم المنافسة لم يجد اهتماما من قبل وهو ما يتعلق بالدور الكبير والهام الذي بدأت تلعبه اتفاقيات العمل الجماعية في تنظيم شروط عدم المنافسة.
وقد حاولت في هذا البحث قدر جهدي ومع قلة المراجع في هذه النقطة بالذات، ان أعرض للمشكلات التى نشأت ومن خلال التطبيق للعلاقة بين عقود العمل الجماعية وعقود العمل الفردية وفي صدد شروط عدم المنافسة ولكي استخلص المبادئ التى تحكم هذا الموضوع.
