من الصعوبة بمكان التأريخ لمفهوم أو مصطلح معين عبر عصور متطاولة كمصطلح الحرية في الفكر الإسلامي الوسيط، خصوصاً إذا كان هذا المفهوم لم يدرس بعد في أي جانب من جوانبه أو عصر من عصور حياته، ليس لأن الاهتمام غاب لدى المسلمين. كما ألمح مؤلف الكتاب فرانز روزنتال وآخرون، بل لأن السؤال المطروح الآن من طبيعة مختلفة تماماً. وهكذا فإن محاولة من هذا القبيل محكوم عليها منذ البدء بأن تتحول إلى عرض مسطح لا عمق له، أو إلى بحث وثائقي يفتح الباب لآخرين للخوض في الموضوع نفسه.
الدراسة التي بين أيدينا عن مفهوم الحرية في الإسلام، هي دراسة توثيقية تجمع أكثر المادة عن الموضوع، وعملية التفتيش هذه ليست بالعملية السهلة، فقد اعتمد المؤلف على أكثر من مئتي مصدر ومرجع تردُ كلمة الحرية في بعضها مرة واحدة أو لا ترد على الإطلاق. ولم يكتف بالمطبوع، بل اطلع اطلاعاً دقيقاً على مخطوطات عدة تتناول الموضوع نفسه وإن بشكل عرضي. وهكذا فإن كتابه مفيد جداً من هذه الناحية. من حيث أنه يجمع بطريقة دقيقة وثائق نادرة عن الحرية مفردات ووجوداً ومفهوماً وواقعاً في المجتمعات الإسلامية الوسيطة.
لكن لهذا الاستقصاء حدود يقف عندها، وقد فاتته أمور مهمة، بعضها يعود إلى المنهج الذي اتبعه، وبعضها يعود إلى ضخامة المادة التي كان عليه أن يقلبها ويستخرج منها ما يتصل بموضوعه، فبينما انهمك في حديث طويل عن السجن باعتباره مانعاً من موانع الحرية تجاهل الأولويات الفقهية الخمس التي يكرر الفقهاء ذكرها، مع أ، ذلك لو حدث لكان كفيلاً بتجنيبه مخاطر تأملات نظرية حول وجود مفاهيم للحرية المدنية عند المسلمين. وما يقال عن الحرية المدنية في هذا المجال يقال عن الحرية الاجتماعية، فلو اتصل به الحديث عن الموضوع وقاده إلى نهاياته المنطقية، لكان عليه أن يعرض، ولو بإيجاز لمفهوم الأمة في الإسلام، وصلة الإمام بالأمة ودور الدولة في الحياتين الاجتماعية والاقتصادية.
