عانت معظم الدول الأفريقية من ظاهرة الحروب الأهلية والصراعات المسلحة, والتي أتسمت في معظمها بالأنتهاكات الخطيرة لحقوق الإنسان, حيث أنها لم تكن ترتكب علي نطاق واسع فقط, بل إنها في كثير من الأحيان كانت ترتكب بأعتبارها تكتيها فعالا من جانب الأطراف المتصارعة, وهو ما نتج عنه تجذر مشاعر العداء والكراهية بين الجماعات والفئات المشكلة للمجتمع الواحد, ومن هنا برزت فكرة إنشاء المحاكم الجنائية الدولية سواء كانت دائمة أو مؤقتة كالية من آليات العدالة الأنتقالية التي تسعي لأستئصال مثل هذه الحالة من العداء والكراهية, وذلك من خلال إجراء محاكمات عادلة لمرتكبي أنتهاكات حقوق الإنسان, وتعويض الضحايا حتي يتم القضاء علي عوامل الأنقسام داخل المجتمع, وتهيئة المجتمعات التي عانت من الصراعات المسلحة والحروب الأهلية لفترات طويلة إلي المضي قدماً في عملية المصالحة, ومن أبرز تلك المحاكمالتي ظهرت في شكل محاكم خاصة, وبناء علي ذلك فإن الإشكالية الرئيسية التي تسعي هذه الدراسة إلي رصدها ومعالجتها هي مدي قدرة المحاكم الخاصة بأعتبارها واحدة من آليات العدالة الأنتقالية, علي تحقيق الأستقرار, وتسوية النزاعات في المجتمعات التي عانت من الصراعات المسلحة والحروب الأهلية لفترات طويلة, وما إذا كانت هذه المحاكم قادرة علي تحقيق الأمن والأستقرار منفردة في هذه المجتمعات؟ أم أنها في حاجة إلي أن تستكمل بآليات أخري.
