ليس هناك أدنى شك في أن الماء هو جوهر وسر الحياة، إذ منه كل شيء حي، وهو ضروري لبقاء الإنسان والحيوان وسائر الكائنات الحية الأخرى، وحديثاً تعاظمت أهمية المياه وأصبح لها دوراً اقتصادياً جديداً بدخولها في مجال الصناعة من خلال عمليات التبريد والتكثيف، فلا يمكن للمصانع وسائر وسائل المواصلات المختلفة من طائرات وسفن ومركبات أن تؤدي دورها في العمل دون المياه، وأصبحت المياه حالياً تحظى بأهمية كبيرة على المستوى الدولي نظراً لندرتها، وتزايد الطلب عليها في ظل الزيادة السكانية الرهيبة على المستوى الدولي، الأمر الذي ينذر بوجود صراعات بين الدول بشأن اقتسام الموارد المائية المتاحة.
وكان من الضروري التعرض بالدراسة والتحليل للوضع القانوني بشأن استخدام مياه النيل، وذلك في ضوء أحكام وأعراف القانون الدولي العام في إطار من الموضوعية والحيادية التامة، وتفنيد الادعاءات التي ساقتها كل من أثيوبيا ودول الهضبة الاستوائية للإتفاقيات القانونية السارية حالياً، وقد أولينا عناية خاصة لدراسة الجوانب القانونية للتطورات الراهنة التي تؤثر على العلاقات بين دول حوض النيل واستخلاص النتائج القانونية المترتبة على ذلك، وكيفية استفادة دولتي المصب مصر والسودان من هذه النتائج، مما كان دافعاً رئيسياً لدراستي لهذا الموضوع الهام.
وتقوم هذه الدراسة على فصل تمهيدي وثلاثة أبواب رئيسية، جاءت على النحو التالي: الفصل التمهيدي: الأنهار الدولية وتقنين القواعد والنظريات التي تحكم استخداماتها، والباب الأول: المبادئ والقواعد القانونية التي تحكم استخدامات الانهار الدولية والباب الثاني: القواعد القانونية والهياكل المؤسسية التي تحكم علاقات دول حوض النيل، أما الباب الثالث: الجوانب القانونية للتطورات المعاصرة بشأن تنظيم العلاقات بين دول حوض النيل.
