لما مثلت المسألة العقارية هذه الأهمية كان حرياً بالمشروع أن يهتم بتنظيم يكفل لكل فرد فى المجتمع الحصول على عقار مناسب, هذا وقد حاول المشرع المصرى معالجة تلك المسألة فتدخل على مراحل بصورة إيجابية تارة وبصورة سلبية تارة أخرى, الأمر الذى نتج عنه وجود مايعرف بالإيجارات المؤبدة المدة.
ولما تنوعت طرق تناول المشرع لمعالجته المشكلة العقارية كانت ظاهرة جديرة بالرصد, ونحن نحاول فى هذا البحث رصد تلك الظاهرة بإلقاء الضوء على وضعها, وما أفرزته من تطبيقات, وما ترتب على ذلك من أثار على الواقع القانونى, وما أسهم فيه هذا الوضع على الأزمة العقارية, وذلك من الناحية القانونية وكذلك من ناحية الشريعة الإسلامية, حيث لا يسعنا أن نغفل عن المصدر الرئيسى للتشريع وهل كان ممثلاً فى تلك المشكلة أم كان على جانب أخر, وكذلك نوضح موقف القضاء المصرى ممثلاً فى محكمة النقض والمحكمة الدستورية العليا, فبالطبع لم تكن غائبة عن المشهد فى جميع مراحله.
