يسعى كتاب "العشيرة بين الشريعة والقانون" أن يوضح بعض الإشكالات والمشاكل التي تعترض دور العشائر العراقية في وقتنا الحاضر وأهمية ذلك الدور في فض النزاعات وحقن الدماء وصيانة حقوق الناس وغيرها من الأدوار الإيجابية للعشيرة وطرح بعض المفاهيم الخاطئة التي يتداولها أبناء العشائر اليوم.
يتكون الكتاب من ستة فصول، في الفصل الأول تعرض المؤلف إلى المعنى العام للعشيرة وما تعنيه هذه الكلمة عند أهل اللغة، والتعريف بنظرة الإسلام إلى العشيرة.
وفي الفصل الثاني استعرض المؤلف خصوصية الشخصية العشارية وأهم العوامل التي تؤثر عليها كالظروف البيئية والمعيشية والإجتماعية وغيرها.
وحاول الفصل الثالث أن يلقي نظرة عامة وشمولية على علاقة العشيرة بالشريعة والتعاليم الإسلامية من جهة، وبالقانون من جهة أخرى.
أما الفصل الرابع فقد خصص إلى وحدة الهدف لهذه الأقطاب الثلاثة – أي الشرع والقانون والعشيرة – ومهما تعددت القوانين الوضعية والعرفية يبقى الهدف الأوحد هو كيفية الحفاظ على الأمن والإستقرار في حياة الفرد والمجتمع من خلال سن بعض الضوابط والتعليمات والمبادىء التي من شأنها أن تنظم حياة الأفراد وعلاقاتهم بالآخرين ممن يحيطون بهم.
وخصص الفصل الخامس للدور الكبير الذي يلعبه شيوخ العشائر وكيفية المحافظة على هذا الدور وحياديته بالتعامل مع الأمور التي تواجه الفرد والمجتمع.
أما الفصل الأخير فكان عبارة عن وقفات وتأملات مع أصحاب العلم والإختصاص الذين يمثلون الشرع والقانون من جهة وشيوخ العشائر من جهة أخرى، ثم عمل المؤلف على تحليل هذه الأقوال والأفكار القيّمة التي قدمت ومن ثم الخروج بخلاصة القول.
