موضوع هذا البحث المرسوم بــ (التنظيم القانوني للتوقيع الإلكتروني وحجيته في الإثبات المدني) يتناول جانباً من إحدى المسائل القانونية التي يثيرها التعاقد الإلكتروني عبر الإنترنت ألا وهي مشكلة إثبات المعاملات والتعاقدات التي تتم بوسائط إلكترونية، فمشكلة الإثبات للمعاملات التي تتم إلكترونياً لها ثلاثة جوانب (الكتابة - التوقيع - والنسخة الأصلية).
والواقع ونظراً لتشعب هذه الجوانب الثلاثة للإثبات بالطريقة الإلكترونية وعدم كفاية رسالة علمية محكومة بعدد محدد من الصفات للإحاطة الوافية والشافية بهذه الجوانب الثلاثة؛ لذا فإن موضوع البحث ينحصر في إحدى هذه الجوانب ألا وهو الجانب المتعلق بالتوقيع الإلكتروني.
سيتم تناول موضوع بحثنا هذا في ثلاثة فصول نسبقها بفصل تمهيدي وذلك على النحو التالي:
الفصل التمهيدي: المفهوم العام للتوقيع التقليدي (المبحث الأول: ماهية التوقيع التقليدي، المبحث الثاني: أطراف وأنواع وصور وشروط التوقيع)، الفصل الأول: المفهوم العام للتوقيع الإلكتروني (المبحث الأول: ماهية التوقيع الإلكتروني، المبحث الثاني: صور التوقيع الإلكتروني ومجالات تطبيقه)، الفصل الثاني: الجهود المبذولة لإعتراف بحجية التوقيع الإلكتروني في إثبات المعاملات (المبحث الأول: جهود المنظمات الدولية، المبحث الثاني: جهود الدول في التنظيم القانوني للتوقيع الإلكتروني)، الفصل الثالث: الحماية الوقائية للتوقيع الإلكتروني (المبحث الأول: التوثيق الإلكتروني، المبحث الثاني: التشفير طريقة لحماية التوقيع الإلكتروني، المبحث الثالث: مدى صحة الاتفاقات المتعلقة بحجية التوقيع الإلكتروني في الإثبات).
