تبحث هذه الدراسة في موضوع النقود الالكترونية، وما تثيره من إلتباسات وغموض دأب الباحث "طارق محمد حمزة" إلى توضيحها في سبيل الوصول إلى تنظيم متكامل لها، ووضع الحلول المناسبة لما يمكن أن يثيره التعامل بها من حيث المعنى المقصود فبطاقات الإئتمان، كما بطاقات الإيفاء، تتطلب وجود حساب مصرفي مسبق تُمنح على أساسه البطاقة، أما بالنسبة للنقود الالكترونية موضوع البحث، فهي عبارة عن مخزون نقدي مسبق الدفع، وبتعبير آخر، هي وسيلة الدفع الالكترونية التي لا تتطلب وجود هذا الحساب في أثناء إجراء الصفقات، فهي قد تم دفعها مسبقاً.
وانطلاقاً من مسألة المنافع التي يأمل أطراف العلاقة أن يجنوها من جراء التعامل بالنقود الالكترونية، كان لا بد من البحث في ما يكفل حماية المتعاملين بالنقود الالكترونية، أي المستهلك والتاجر والمصدر الذين قد يتعرضون لمخاطر أثناء إجرائهم الصفقات. فجاءت هذه الدراسة لتبحث في إمكانية وضع نظام قانوني شامل للنقود الإلكترونية يتضمن تحديد مفهومها، وكيفية إصدار هذه النقود وإدارة هذا الإصدار، بالإضافة إلى البحث في كافة المسائل المثارة نتيجة التعامل بها، ووضع مقاربة شاملة للحلول التي يمكن أن تعالج هذه المسائل.
تأتي أهمية هذا البحث في هذا الموضوع بناءً للأهمية التي يمكن أن تكتسبها النقود الالكترونية في المستقبل، واحتمال حلولها كبديل نقدي حقيقي للنقود القانونية بالنسبة للصفقات المنخفضة القيمة، ومحاولة إلقاء الضوء على هذه الظاهرة النقدية الجديدة، يمكن له أن يساهم في تسهيل مهمة القيمين على وضع التشريعات، في حال اتجاه النية لوضع تنظيم خاص بهذه النقود في البلدان العربية.
ومن أجل التعرّف إلى موضوع النقود الالكترونية، تم تقسيم هذه الدراسة إلى قسمين منفصلين حيث يعالج القسم الأول البنية التنظيمية للنقود الالكترونية، فيما يختص القسم الثاني بدراسة النقود الالكترونية من الوجهة التطبيقية.
