إن طبيعة العلاقة بين المؤسسة المدنية والمؤسسة العسكرية تعتبر من المعايير الأساسية (إن لم تكن المعيار الوحيد في بعض الأحيان) الذي تقاس عليها مستوى العدالة والحرية والأمن والإستقرار والديمقراطية الذي يعيشه مجتمع ما في دولةٍ معينة.
وبما أن الدستور هو الذي يعنى بوضع الخط العريض لطبيعة النظام في الدولة ومهامه وكيفية ممارسة لهذه المهام وتنظيمه للسلطة مع الإقرار بالحقوق والحريات الأساسية التي يجب أن يتمتع بها كل مواطن سواسية دون إستثناء، فهو من سيضطلع برسم الإطار السليم للعلاقة التي تربط الجانب العسكري من الدولة بجانبها المدني، وعليه أن يضمن دفاعاً وأمناً قويين للدولة على الصعيدين الداخلي والخارجي، وأن يضمن في الوقت نفسه حماية حقوق الشعب وعدم إنتهاكها بإجراءات وأساليب تعسفية بنفس الدرجة من القوة والإهتمام، وهو ما يصعب تحققه إلا في مجتمع تخضع فيه القوات العسكرية إلى قيادات ومؤسسات مدنية.
تعود أهمية هذه الدراسة في بحثها وتحليلها لموضوع مهم وهو القوة التي تتمتع بها المؤسسة العسكرية في الدولة ومدى مراعاتها وإلتزامها صيانة حقوق الأفراد وحرياتهم فيها بموجب الدستور، وكذلك تنصرف إلى تقدير المساوئ التي قد تصل إلى حد الأهوال والكوارث حينما تسيطر المؤسسة العسكرية بما لها من قوة وسلطة على المؤسسات المدنية وتساهم أو قد تنفرد في رسم العملية السياسية للدولة التي ستنطبع عليها بدون شك تصرفات الدولة في الداخل والخارج فهي دراسة ذات أبعاد قانونية وإجتماعية وسياسية وثقافية.
وبالتالي تأتي أهمية هذه الدراسة في تسليط الضوء على تبعات ونتائج سيطرة المؤسسة العسكرية على باقي مؤسسات الدولة والتي نجدها في تجارب دول عديدة منها العراق (بما فيها إقليم كوردستان) ومصر وتركيا وغيرها.
