هذا الكتاب دراسة علمية تشق طريقها فى جعل المصلحة المرسلة داخل منظومة النصوص الشرعية الجزئية والكلية . مع مناقشة مستفيضة لشبهات من يرى ان المصلحة المرسلة تقدم على النص والاجماع وان هناك تعارضا حقيقيا بين المصلحة والنص احيانا وان الصحابة خالفوا النصوص للمصلحة التى بدت لهم وان العقل يستقل بادرالك المصالح هذا مع مناقشة لتيار اخرى يرى عدم الحاجة الى العمل بالمصلحة المرسلة لكفاية النصوص والخوف من احتواء علماء السوء فلا يعمل بالمصلحة احتياطا وهو اتجاه يحجر واسعا ويجعل الشريعة قاصرة عن مواكبة المستجدات هذا مع مناقشة الضوابط الشرعية للعمل بالمصلحة حتى يكون نسيج النصوص والمصلحة المرسلة معا ثوبا متناسقا فى تغطية وكسوة جميع المستجدات بالحنيفية السمحاء وليس باتباه الاهواء ، وقد تضمنت الدراسة ايضا امثلة من تاريخنا الفقهى وواقعنا الحالى مصدرها العمل بالمصالح المرسلة .
