اتسم العصر الراهن بالتقدم العلمي الكبير في كافة المجالات، فما كان بالأمس مجرد خيالاً أصبح اليوم حقيقة. ومن أبرز هذه المجالات العديدة الطب، ففي كل يوم تشرق فيه الشمس تطالعنا وسائل الإعلام المرئية والمسموعة والمقروءة عن اكتشافات علمية يقف العقل أمامها مبهوراً بها وحائراً حول مدى مشروعيتها في ضوء جدواها للبشرية.
وكان للنجاح العلمي الكبير الذي توصل إليه فريق معهد "روزلين" للأبحاث العلمية في أسكتلنده بقيادة "ايان ويل موت" والذي تجسد في استنساخ شاه طبق الأصل من نعجة وإعلانهم إمكانية تطبيق التقنية نفسها لاستنساخ كائنات إنسانية الأكثر الكبير في اختيار موضوع بحثي هذا "الانجاب بين التجريم والمشروعية" نظراً لتعلقه بعملية إنجاب طفل جديد عبارة عن نسخة طبق الأصل من إنسان آخر، وذلك عن طريق أخذ خلية حية من ثدي الإنسان المرغوب إنجاب نسخة منه وتلقيحها ببويضة أنثى بعد تفريغها ثم زرعها في الرحم لتبدأ مراحل الحمل الطبيعي عقب ذلك.
وقد أثارت هذه الصورة الجديدة والغريبة للإنجاب (لو قدرها النجاح على الإنسان في المستقبل) تساؤلات عديدة في نفسي تتعلق بمدى مشروعية الإنجاب بهذه الوسيلة غير الطبيعية وبمدى مشروعية صورة أخرى قريبة منها توصل إليها الطب حديثاً تمكن من يعاني من عدم القدرة على الإنجاب في صورته الطبيعية من الإنجاب عن طريق تلقيح مني الرجل ببويضة الأنثى صناعياً.
وإزاء التساؤلات السابقة والتي تدور حول مدى مشروعية الإنجاب بمحاوره الثلاثة: رفض الإنجاب رغم القدرة عليه، والسعي للإنجاب بأي وسيلة غير طبيعية، وأخيراً السعي لإنجاب طفل ذو مواصفات معينة كان لابد من التصدي له بالبحث من كافة جوانبه الشرعية والقانونية والطبية سعياً للوقوف على إجابات التساؤلات السابقة.
