الطائرة كالسفينة تتمتع بكيان ذاتي , تبدأ في اكتسابه من لحظة الكشف عليها , وإعطائها شهادة الصلاحية للطيران , إذا يدزن في هذه الشهادة خصائصها وميزاتها , ثم يتأكد هذا الكيان حينما تسجل في السجل الخاص بالطائرات , فتكتسب جنسية الدولة التي تم بها التسجيل , وتتمتع بحقوق معينة كما تخضع لإشراف الدولة .
يقصد بمبدأ الاختصاص الإليمي في الأمور الجنائية أن القانون الجنائي للدولة هو الذي يسري على كل ما يقع في إقليمها الدولة من جرائم أيا كانت جنسية مرتكب الجريمة , سواء أكان وطنيا أم أجنبيا , وعلى العكس من ذلك لا سلطان للقانون الجنائي للدولة على ما يقع خارج إقليمها من جرائم أيا كانت صفة مرتكب الجريمة أو جنسيته .
يمثل الأختصاص الجنائي في الجرائم المرتكبة ضد الطائرات في الأجواء الإقليمية احدى المسائل التي دار حولها الجدل والاختلاف الفقهي كما تعارضت بشأنها أحكام القوانين الوطنية وذلك للإشكالات التي يثيرها تعيين هذا النوع من الاختصاص , وما زاد هذه المسألة تعقيدا هو تشابك المصالح الوطنية والاعتبارات الدولية بهذا المجال , إذا غالبا ما يختط كل مشروع طريقا إزاء تحديد الاختصاص الجنائي بهذه الجرائم والمشروع هنا يفضل اختصاص قانونه - في أغلب الأحيان - على غيره من الاختصاصات .
فاختلاف السبل التي تسلكها القوانين الوطنية يؤدي إلى بروز التعارض بين أحكام هذه القوانين , بحيث يصل الأمر إلى درج أن تتمسك كل دولة من الدول ذات العلاقة باختصاصها المانع "Exclusive " تجاه هذه الجرائم وما قد يستتعبه ذلك من صراعات بين الدول لا تخدم استقرار المجتمع الدولي الذي ينبغي أن يسود علاقاته التفاهم المشترك والتعاون المتواصل .
