Book Description
بشّر الدين الإسلامي بمبدأ العدل والمساواة بين الناس، وتأكد العمل بهذا المبدأ في القرآن الكريم والسنّة النبوية.
لكن الحقائق أثبتت أن هذه الدعوة، وغيرها من الدعوات المماثلة لها، والتي بشّرت بها الشرائع الأخرى والفلاسفة، أضحت مثالية، وأن معاملة الأفراد بكل مقاييس المساواة أمر طوباوي وأنّ الإسلام الذي نلسمه في النص (القرآن والسنّة) ليس هو إسلام التاريخ، أي الإسلام الذي مارسه ولاة الأمور الساهرون على شؤون الرعية، الأمر الذي أحدث خللاً في السير الطبيعي لنسق الحياة في صلب المجتمعات الإسلامية، واستوجب التدخّل بوضع آلية بديلة، إذ إنّ "الله يزع بالسلطان ما لا يزع بالقرآن"، وتمثّلت هذه الآلية التي أوكلت إليها مهمّة بسط سلطان العدل في جهاز القضاء.
إلاّ أنّ القضاء، وكما أثبتته الوقائع والأحداث، لم يستطع أن ينال أصحاب الجاه الّذين كانوا يعتبرون أنفسهم في حلّ من كلّ مفاهيم القضاء وإجراءاته وثوابته.
ونتج من ذلك تفشّي الظلم وتعدّد المظالم الصادرة عن ذوي الجاه وأصحاب النفوذ، الأمر الذي استوجب تدخّل السلطة السياسية، بإعتبارها حامية للعدل وراعية له، وتمثّل هذا التدخّل فيما أطلقنا عليه "النظر في المظالم".
بدأ النظر في المظالم في تاريخ الحضارة الإسلامية كظاهرة مقتبسة عن أمم سابقة، وهذه الظاهرة لم تكن تقليداً قاراً، بل خاضعاً لعوامل وظروف وملابسات عدّة، وقد اصطبغ أحياناً بالصبغة الدعائية خدمة لبعض الدعوات المعارضة، الأمر الذي أدّى إلى تداخل الأمور وإضطرابها حتى في تحديد مفهوم الظلم.
وإذ التزمت السلطة المعرفية (الفقهاء) بالتنظير لولاية المظالم وتحديد مسارها ودورها وطرق عملها، فقد أحكمت السلطة السياسية قبضتها عليها، حتى أصبح التنظير في وادٍ والممارسة في وادٍ آخر.
فهل يكشف تتبع مسار ولاية المظالم، في هذا البحث، عن التناقض الواضح بين إسلام النص وإسلام التاريخ؟.
