ولما ظهرت حركة "التشريع" في الدول الإسلامية، نقلت في قوانينها ما كان قد استقر في الغرب من نظام "الفائدة" المحدد سقفها الأعلى بمرونة مع اعتبار تجاوز ذلك السقف ممنوعًا عاقبت عليه بعض القوانين بوصفه جريمة جنائية، واستنساخ قوانين الدول الإسلامية لموضوع الفوائد على الديوان من التشريعات الغربية دفع الكثير من المشتغلين بالفقه الإسلامي إلى اعتبار نظام "الفائدة" المنقول عن الغرب ربا أيا كانت نسبتها وصادفت هذه المقولة قبولًا واسعًا.
وقد ترتبت على هذا الرأي الدغمائي عدة نتائج أهمها:- حصر الربا في الزياة في القرض أيا كانت نسبتها،وإباحة الزيادة بدون حدود في جميع عقود المعاوضة التي سهل الاستغناء بها عن القرض مع الحرية المطلقة للممول في تحديد العائد الذي يريده لرأسماله، مفهوم الربا أضحى غير قابل للتحليل العقلي، ولا للتعليل المنطقي، التقاعس عن البحث الجدي عن بديل للفوائد "الربوية" يخفف العبء عن المحتاج إلى الاستدانة، وتم الاكتفاء ببدائل تزيد من هذا العبء وتضاعفه، إهمال مناقشة الأسباب الواقعية التي أدت إلى صدور فتوى شيخ الإسلام في القرن العاشر بتحديد "الزيادة" التي يحق للدائن إضافتها بدل ترك ذلك إلى ما يفرضه هو بإرادته الجشعة على المدين المغلوب على أمره، خطاب متهافت وغير مقنع في الترويج لما سمي "بالبنوك" الإسلامية، وسنرى هذا تفصيلًا في القسم الثاني من هذه الدراسة التي نعرضها في قسمين:
