لأجل ذلك جاءت هذه الدراسة في فصلين: يدرس الفصل الأول الحقوق والحريات والواجبات العامة من الشريعة الإسلامية كحق الحياة وحرية الرأي والتعبير وحق المشاركة السياسية، وكذلك يبنى الكتاب هذا الحق في الموائيق الدولية كالإعلان العالمي لحقوق الإنسان والاتفاقية الأوربية لحقوق الإنسان بجميع موادها. أما الفصل الثاني فيدرس الحقوق والحريات والواجبات العامة في الدساتير العربية والأجنبية، حيث تضمنت دول العالم في دساتيرها مجموعة من الحقوق والحريات والواجبات العامة كحق الحياة وحق الأمل الشخصي وحق إبداء الاراء والأفكار وحرية الصحافة وحرية التعليم... الخ. كذلك يتضمن الكتاب الحقوق والحريات والواجبات العامة في الدستور الأمريكي، والدستور الإيراني.
