هذا الكتاب محاولة لقراءة النهضة الحسينية قراءة فقهية ، وبمعنى آخر دراسة العلاقة التأريخية للنهضة الحسينية والبعد الفقهي ، وبيان أن النهضة الحسينية تمثل الجانب العملي الأمر بالمعروف والنهي عن المنكر ، من خلال تسليط الضوء على السلوك الفعلي لأصحاب النهضة ومدى ارتباطهم بالإسلام المحمدي . من هنا يسلّط المؤلف الضوء على الأحكام الشرعية في النهضة الحسينية ، لمعرفة مدى تقبل تلك الأحكام للتعريف والتطبيق ، ومن ثمّ تحويلها إلى عناوين فقهية تشخيصية ، يمكن البناء عليها وجعلها منهاج عمل على مر العصور ، ولذلك سعى المؤلف إلى تقديم تفسير فقهي للنهضة الحسينية من خلال تحليل الآيات القرآنية والأحاديث النبوية ، للقول " إنها سنّة واجب اتباعها ، فيمكن أن تكون شاهد على تخصيص الآيات ؛ لأن قول المعصوم وفعله وتقريره حجة " .
وبناءً على ما تقدم ، تبرز هذه الدراسة الصورة الواقعية لأهل البيت عليهم السلام ، وموقف الفقهاء من مسألة التقية ، بين مشروعيتها أو عدمها ، والجواب عما إذا كانت تكليف شرعي لا يقف عند عصر معين وإنما مستمر ، وكل ذلك من خلال الرجوع إلى النظريات الفقهية لشرعية النهضة الحسينية ، والتفسير الفقهي لها عبر مرجعية أهل البيت عليهم السلام .
