تناولت هذه الدراسة أهمية التوثيق وأثره على الزواج والطلاق، وذلك من خلال البحث في أهمية التوثيق وشروطه، وبيان دواعيه في هذا الزمان، وبيان الآثار المترتبة على عدم التوثيق وصلة ذلك بتغير الزمان وفساد الذمم.
وقد عرض الباحث المسائل المتعلقة في توثيق عقد النجاح وما يترتب على ذلك من آثار كتوثيق المهر، ومهر السر والعلن، وزيادة المهر أو إنقاصه، وإشتراط أحد الزوجين الشروط في عقد الزواج، كما تعرض الباحث إلى تطبيقات معاصرة للعقود غير الموثقة، وحكم هذه الصور الحديثة وضوابط الأخذ ببعضها، وما هي الحلول المقترحة للحد منها ومعالجتها؟.
وقد حرر الباحث محل النزاع في مسألة الإشهاد على الطلاق وبيان الرأي الراجح، وتعرض إلى حجية توثيق الطلاق أمام الموثق، وعلاقة ذلك بإرادة الزوج المنفردة في إيقاع الطلاق، وما هي المقاصد الشرعية المتوخاة من القيود المشروعة في طريق الطلاق؟.
ومن خلال هذا الكتاب أمكن التوصل إلى عدد من النقاط، أهمها: "إن توثيق الزواج والطلاق واجب شرعاً لما فيه في هذا الزمان من حفظ الحقوق"، "إن الله عزّ وجلّ جعل عقد النجاح ميثاقاً غليظاً فيجب ألا يتهاون فيه".
