إن الأهمية الإستراتيجية والاقتصادية للبحار، غذت رغبة الدول في مد نفوذها لأبعد نقطة فيها، فكانت البحار، بذلك، مسرحا للعديد من النزاعات، الصراعات والحروب البحرية، التي ساد- في الغالب- منطق القوة في تسويتها. غير أن الدول، وبفعل الآثار السلبية للحروب، أيقنت أنه لا بد من الجنوح نحو منطق الحل السلمي لمنازعاتها ولا بد من إيجاد نظام قانوني خاص بالبحار، فكان مؤتمر السلام الأول المنعقد بلاهاي سنة1899، بادرة لإقرار أول اتفاقية للتسوية السلمية للمنازعات الدولية، بحيث أشارت مادتها الأولى إلى سعي الدول لبذل جهودها قصد حل نزاعاتها بالطرق السلمية، كما تضمنت الاتفاقية، ولأجل ذلك، أحكاما تتعلق بالمساعي الحميدة، الوساطة، التحقيق والتحكيم، وأشارت في مادتها العشرين إلى إنشاء المحكمة الدائمة للتحكيم الدولية، مبينة اختصاصها وقواعد سيرها في المواد 21-57.تم تأكيد هذه الأحكام عند مراجعة هذه الاتفاقية خلال مؤتمر السلام الثاني المنعقد بلاهاي أيضا، سنة 1907،بموجب المواد: 01،41-90 من اتفاقية التسوية السلمية للمنازعات الدولية لسنة 1907، وإن طالها شيء من التعديل، تعلق أساسا بإضافة أحكام في باب لجان التحقيق الدولية، إضافة بنود تتعلق بالإجراءات المختصرة في مجال التحكيم الدولي، والتصدي لمسألة استحالة تشكيل محكمة التحكيم بسبب عدم اتفاق الدولتين المعينتين على محكم رئيس
