Book Description
أنشئ المركز الدولي لتسوية منازعات الإستثمار، (ICSID) أو "المركز" الذي استحدثه البنك الدولي للتعمير والإنشاء (IBRD)، من قِبَل إتفاقية واشنطن المتعدّدة الجوانب، حول تسوية منازعات الإستثمار بين الدول ومواطني الدول الأخرى، وذلك في العام 1965، ويقع المركز في العاصمة الأميركية واشنطن دي سي، وهو تابع للبنك الدولي.
وتهدف إتفاقية المركز الدولي لتسوية منازعات الإستثمار (ICSID) إلى تعزيز تدفّق الرأسمال الخاص الأجنبي للدول النامية، عن طريق إستحداث مؤسسة وآليّة "لتسهيل تسوية المنازعات بين الدول والمستثمرين الأجانب"، تفسّر الطبيعة الخاصة للمنازعات المشمولة ضمن إختصاص المركز.
والغرض من هذا الكتاب هو دراسة معنى الشروط اللازمة لإنعقاد الإختصاص المحدّدة في إتفاقية المركز الدولي لتسوية منازعات الإستثمار (ICSID) من خلال دراسة تحليلية ونقدية للنصوص ذات الصلة، في إتفاقية المركز المذكور (في ضوء الفقه المتنامي حول شؤون الإختصاص في المركز الدولي لتسوية منازعات الإستثمار) وسوف يلاحظ أنّ ممارسات هيئات المركز الدولي لتسوية منازعات الإستثمار (ICSID) تطرح مسائل واسعة متعلّقة بمختلف أوجه الإختصاص.
وستوضح هذه الدراسة أنّ القيود الإختصاصية لإتفاقية المركز الدولي لتسوية منازعات الإستثمار لا تشكّل عقبة حقيقية لهيئات المركز (ICSID) في تحديد إختصاص المركز وسلطته على المنازعات التي تعرض عليه.
وسيركّز هذا الكتاب على الطعون الإختصاصية المختلفة التي يمكن طرحها، بعد تقديم النزاع إلى المركز، وسينظر في جميع المتطلّبات الإختصاصية في هذا السياق، وسوف تؤخذ بالإعتبار جنسية أطراف المركز الدولي لتسوية منازعات للإستثمار (ICSID) عند دراسة اهلية هؤلاء الأطراف، وسيتمّ التطرّق إلى موضوعين إضافيين وتأثيرهما على المسائل الإختصاصية، وهما مفاهيم السيطرة الأجنبية والحماية الدبلوماسية كما ذكرنا سابقاً.
