الزنا لم يعرف إلا حين عرف الزواج, فبالزواج أستأثر الرجل بالمرأة وأصبح يتأذى من أى إعتداء على حقه هذا, ويثور إذا ما إعتدى أحد غيره على هذا الحق وقد يصل به الأمر إلى القتل غسلاً للعار الذى لحقه وأهله.
وللزنا فى القوانين الوضعية معنى إصطلاحى خاص, فهو لا يشمل كل وطء بين الرجل والمرأة بغير زواج وفق المصطلح الشرعى, وإنما هو مقصور على حالة زنا الشخص المتزوج حال قيام الزوجية فعلاً أو حكماً. فالزنا فى القوانين الوضعية معناه "خيانة العلاقة الزوجية".
