لقد جعل الله تعالى مصادر الشَّريعة متنوِّعة ومتعدِّدة، وهذا التنوُّع دلَّ على مرونة هذه الشَّريعة وعالميِّتها، وإستيعابها لكل أحداث الزمان، ما وقع منها وما سيقع إلى يوم القيامة، والحياة المعاصرة مملوءة بالمسائل المستجدَّة، ولا سيَّما المعاملات الماليَّة التي تعدُّ من أكثر المسائل تجدُّداً، والتي توجب على فقهاء العصر دراستَها دراسة عميقة وافيةً، وأن يُنظر إلى التكييف الشَّرعي للصور المستحدثَة حتى يمكن بيان الحكم الشَّرعي لها.
ومن هذه المصادر التي تدلُّ على مرونة الشَّريعة الإسلامية ورحابتها: دليل الإستصحاب، وهناك بعض الباحثين الذين تصدَّوا لدراسة موضوع الإستصحاب من الناحية الأصولية، وبعضهم بيَّن أثره في الفقه الإسلامي عامة، وذلك من خلال عرضِ عدَّة أمثلة من أبواب الفقه عموماً.
ولكن لم يبين الباحث أمر هذا الدليل في المعاملات الماليَّة على الخصوص، وذلك على الرَّغم من أهميتها، وسعة المجال للبحث فيها، فالإستصحاب له أهميَّة كبيرة في معرفة حكم كثير من مسائل المعاملات الماليَّة عموماً؛ والمعاصرة منها على وجه الخصوص؛ وذلك بناءً على إستصحاب الإباحة الأصلية، وعلى أن الأصل في المعاملات الإباحة، كما أنَّه بواسطة الإستصحاب يرتفع الشَّك عن كل أمر حصل الشَّك في بقائه بعد ثبوته، أو في وجوده بعد عدمه.
لذلك اختار المؤلف هذا الدَّليل لمعرفة أثره في المعاملات الماليَّة على وجه الخصوص، ومحاولة لإستقراء مسائل المعاملات الماليَّة التي تندرج تحت هذا الدليل، وضبطها بقواعدَ فقيهةٍ تجمع ما تفرَّق من أمثلةٍ في أبواب المعاملات المالية.
