يقدم البروفيسور أبو الفضل لهذا الكتاب عصارة سنوات من التعليم الشرعي والإسلامي، كما يقدم خبرته وتجربته كمحامي ومستغرق في خطب فقهية إسلامية. ومن خلال دراسة قضيته الواردة في الكتاب يبين بجلاء أن الفقه الإسلامي ليس ملعبًا يمكن لكل من هب ودب أن يجري فيه.
ففي هذا الكتاب يستخدم البروفيسور أبو الفضل قضية معاصرة؛ لكي يبرز منهجية التحقيق الشرعي الذي يمثل حجر الزاوية للتقاليد الفقهية الإسلامية، وهو هنا لا يلفت النظر فحسب إلى تقصير أولئك الذين يسمحون لأنفسهم كيفما اتفق بالخوض في مناقشة الفقه الإسلامي، وإنما يزودنا أيضًا برؤية متبصرة لتعقيدات التحليل الشرعي، وعواقب فشل المرء في إلزام نفسه بتوخي أقصى درجات الحيطة والاعتناء. وفي هذه الدراسة الخصبة، يعول البروفيسور أبو الفضل على ثراء التقاليد الإسلامية في وضع نموذج للتحليل الشرعي الإسلامي، فيمهد أولًا: بالمطابقة والتمييز بين ما هو مرجعي وما هو استبدادي في الخطب الإسلامية، ثم يحدد ثانيًا: ملامح علم منهج الأحاديث النبوية الشريفة، ومن خلاله يطالب بعلاقة نسبية بين التأثير الفقهي والاجتماعي لحديث شريف، وبين درجة الوثوق فيه، ثم يؤكد ثالثًا وأخيرًا: أنه لكي يتحاشى المرء النزعة الاستبدادية يجب عليه اجتياز اختبار من شعبتين، هما: كبح جماح النفس، وإلزامها الاجتهاد الدقيق. وهذه الدراسة الواعدة يمكن أن تصبح علامة فارقة في الفكر الشرعي الإسلامي؛ إذ بينما غاص البروفيسور أبو الفضل إلى جذور الخطب الإسلامية التقليدية فقد جاء عمله مبتكرًا غير مسبوق.
