Book Description
يعتبر موضوع تنظيم النسل من أهم قضايا العصر، وقد تباينت الأفكار وتشعبت وتضاربت الأفكار وتنوّعت حول هذا الموضوع. والذي يؤدي بالناس إلى هذا التباين والتضارب حول هذه القصة هو الاعتقاد السائد لدى بعضهم أن التزايد السكاني في العام يهدّد بوقوع مجاعات وكوارث، ومن ثم فلا بد من إيجاد التوازن بين الموارد وعدد السكان. من أجل ذلك كانت قضية تنظيم النسل هي قضية العصر الذي نعيش فيه، وأن البحث فيها وفي غيرها من القضايا المعاصرة أصبح مفروضاً على طالبي العلم حتى يظهر موقف الشريعة الإسلامية منها.
من هنا كانت تسمية الباحث لرسالته هذه "موقف الشريعة الإسلامية من تنظيم النسل"، ليبين فيه نظرة الإسلام للأسرة باعتبار أنها هي الصورة الطبيعية للحياة المستقرة التي تلبّي رغائب الإنسان وتفي بحاجاته. وأما منهج الباحث فقد كان المنهج الاستنباطي الذي يعتمد على الاستقراء والتتبع لجزئيات المسألة وحججها وأدلتها واستخلاص النتائج وتحليلها. وقد جاء هذا البحث ضمن مقدمة وتمهيد وثلاثة أبواب وخاتمة.
أما المقدمة فقد ذكر فيها الباحث سبب اختياره لهذا الموضوع والمنهج الذي اتبعه في هذا البحث. وأما التمهيد فقد تمّ فيه إيضاح نظرة الشريعة الإسلامية إلى النسل، وبيان المعنى اللغوي والاصطلاحي للنسل، وبما كان يعرف تنظيم النسل في القدم وما عرف به في الحديث، والمعنى الخاص للتنظيم والتحديد والضبط والمراد منها جميعاً، وثم أيضاً بين المدلول الاصطلاحي له عند الاجتماعيين والمختار منهم جميعاً. وأما الباب الأول فقد تناول فيه الباحث النسل بين الإكثار والإقلال والدعوة إلى تنظيمه. وتمّ تخصيص الباب الثاني لبيان حكم تنظيم النسل في الشريعة الإسلامية. وفي الباب الثالث والأخير تمّ الحديث عن حرية الاعتداء على الجنين.
