لجأ الإسلام منذ البداية - بدافع الضرورة - إلى اعتماد مبدأ التمييز بين المسلمين وغير المسلمين لأسباب ذات طابع ديني ولظروف تاريخية واعتبارات سياسية. هذه المعطيات كانت في أساس التمييز الذي حكم العلاقات بين المسلمين وغير المسلمين. وفي العقد العثماني ألغي عقد الذمة وهو الركن الأساسي للأوضاع القانونية للنصارى واليهود في ديار الإسلام وتغير الأساس القانوني للحريات والحقوق التي يتمتع بها هؤلاء، وباعتماد مبدأ المواطنة الذي أقرته التنظيمات العثمانية. كل ذلك تسبب في إلغاء الأهمية التاريخية والقانونية لدراسة تلك الأوضاع في العصر العثماني.
ومن هنا كان حصر موضوع هذا الكتاب بالعصور التي سبقت ذا أهمية تنطلق من واقع ديني وقانوني، تاريخي، (عصور الخلفاء العرب). من هذا المنطلق كان التحول الذي لامس نظام أهل الذمة في هذه الفترة التاريخية شديد الدقة والتناسق، لأن النظرية والممارسة تداخلتا وتفاعلتا بحيث كانت إحداهما تؤثر في الأخرى وتعدل مسارها، لتنشأ عن ذلك مساهمة هذا التداخل في إقامة ما يمكن أن نسميه النظام التقليدي. هذا النظام كان شديد التأثير باعتبارات سياسية وقانونية. ومن هنا كان تخصيص القسم الأول من هذا البحث لدراسة الوضع القانوني للكتابي أو الذي من الوجهة السياسية باعتباره أحد أفراد الرعية، كما كان شديد التأثير باعتبارات ذات طابع اقتصادي لأن الكتابي كان مكلفاً بمهمة اقتصادية في خدمة الدولة الإسلامية، ومن ثم كان تخصيص القسم الثاني لدراسة الوضع القانوني للكتابي عبر هذه الظاهرة أيضاً.
